Generale Conditions

1. INTRODUCTION

These General Conditions are an integral part of your agreement to purchase and real estate.

2. ORGANIZATION

The sale of immovable property, are the responsibility of the commercial company Colard & Potty, Ldª, under the name Cop Immo having its registered office Rua Primero de Maio – 82 – Gandra – 4740-472 Esposende – no fiscal 514576600

3. PURCHASE AND SALE AGREEMENT

A purchase and sale agreement will be signed between the parties either, Colard&Potty Ldª (Cop Immo) and the purchaser. This will define the methods of payment, cancellation, receipt and transfer of authentic documents to the notary.

4. DOCUMENTS

The acquirers will provide all the documents necessary for the execution of the authentic document at the notary.
The seller will deliver at the time of the execution of the authentic document at the notary all the documents relating to the transfer of ownership of the object of the transaction.

5. PAYMENT OF FEES

The costs of issuing authentic documents at the notary’s office, and all other administrative costs, are borne by the client.

6. CANCELLATION

The cancellation of the purchase and sale by the customer entails the following fees in order to cover our administrative costs, the cancellation fees charged by our service providers and pay the work already done.

• Less than 15 days before work begins 10% of total amount
• More than 15 days before work begins 5% of total amount.

7. REFUNDS

In the event of failure to carry out the works provided for in the purchase and sale agreement, Colard&Potty Ldª (Cop Immo) will reimburse the clients the sums collected as a deposit on the works provided that Colard&Potty Ldª (Cop Immo) is responsible for their non-execution.

8. AMENDMENTS

If, at the time of signature of the Agreement of Purchase and Sale, the Purchaser requests non-previous changes, the Agreement of Purchase and Sale will be quoted and invoiced in addition to the price agreed in the Agreement of Purchase and Sale

9. CLAIMS

The complaints will be considered admissible on the condition that they reach the office of Colard&Potty Ldª (COP Immo) within 30 days after the passage of authentic document at the notary (The legal guarantees of constructions being of strict application)

10. CIVIL LIABILITY INSURANCE

Cop Immo si insured via Colard&Potty Ldª in civil liability with the company FIDELIDADE.

11. REMARKS

• These special conditions form an integral part of each contract
• Special and general conditions may be adapted by additional notes agreed between the parties.

These general terms and conditions of sale are translated from Portuguese (official language of Colard&Potty Ldª, company governed by Portuguese law). In case of disputes, the general conditions in Portuguese will prevail.
